{"id":14829,"date":"2026-07-26T18:53:04","date_gmt":"2026-07-26T15:53:04","guid":{"rendered":"https:\/\/delta-medlab.com\/?page_id=14829"},"modified":"2026-07-26T19:14:32","modified_gmt":"2026-07-26T16:14:32","slug":"app-terms-of-use","status":"publish","type":"page","link":"https:\/\/delta-medlab.com\/en\/app-terms-of-use\/","title":{"rendered":"Terms Of Use"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"14829\" class=\"elementor elementor-14829\" data-elementor-post-type=\"page\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4accbd1 e-flex e-con-boxed e-con e-parent\" data-id=\"4accbd1\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-77cdf03b elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"77cdf03b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2 data-path-to-node=\"2\">Terms of Use (TOS) Agreement<\/h2><p data-path-to-node=\"3\">This Terms of Service (<b data-path-to-node=\"3\" data-index-in-node=\"23\">Agreement\/&#8221;TOS&#8221;<\/b>) creates and represents a legally binding agreement made by and between <b data-path-to-node=\"3\" data-index-in-node=\"111\">Delta Medical Laboratory \/ Service Provider<\/b> (hereinafter referred to as the <b data-path-to-node=\"3\" data-index-in-node=\"187\">&#8220;Service Provider&#8221;<\/b>), and you, acting in your capacity as an individual and, if applicable, on behalf of the entity you are legally representing or for whom you are using this mobile application\/Website (hereinafter referred to as <b data-path-to-node=\"3\" data-index-in-node=\"417\">&#8220;You&#8221;<\/b>).<\/p><p data-path-to-node=\"4\">These TOS, as well as the Service Provider privacy policy available at <a class=\"ng-star-inserted\" href=\"https:\/\/delta-medlab.com\/\" target=\"_blank\" rel=\"noopener\" data-hveid=\"0\" data-ved=\"0CAAQ_4QMahgKEwikkNWh2fCVAxUAAAAAHQAAAAAQkQE\">https:\/\/delta-medlab.com\/<\/a>, form legally binding Agreements between You and the Service Provider. By using Service Provider Services, you understand and agree that You are fully able and competent to enter into the terms, conditions, obligations, representations, and responsibilities set forth in these TOS, and to abide and comply with these TOS.<\/p><h3 data-path-to-node=\"6\">2. Purpose &amp; Object of the Agreement\/TOS<\/h3><ul data-path-to-node=\"7\"><li><p data-path-to-node=\"7,0,0\"><b data-path-to-node=\"7,0,0\" data-index-in-node=\"0\">2-1<\/b> These TOS govern your access to and use of the site <a class=\"ng-star-inserted\" href=\"https:\/\/delta-medlab.com\/\" target=\"_blank\" rel=\"noopener\" data-hveid=\"0\" data-ved=\"0CAAQ_4QMahgKEwikkNWh2fCVAxUAAAAAHQAAAAAQkgE\">https:\/\/delta-medlab.com\/<\/a> (Site) in addit<span class=\"citation-18471\">ion to the Delta Medical Laboratory and any other World Wide Website owned, created, operated, licensed, or controlled by the Service Provider (collectively, the <\/span><b data-path-to-node=\"7,0,0\" data-index-in-node=\"259\"><span class=\"citation-18471\">&#8220;Website&#8221;<\/span><\/b><span class=\"citation-18471 citation-end-18471\">) and all other products, service<\/span>s or applications offered or developed by the Service Provider on the Website (referred to hereinafter singularly\/collectively as the <b data-path-to-node=\"7,0,0\" data-index-in-node=\"435\">&#8220;Services&#8221;<\/b>).<\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"7,1,0\"><b data-path-to-node=\"7,1,0\" data-index-in-node=\"0\">2-3<\/b> These TOS will also govern and apply to all visitors, users, subscribers, and others who access the application and use the Services (<b data-path-to-node=\"7,1,0\" data-index-in-node=\"138\">&#8220;Users&#8221;<\/b>).<\/p><\/li><li><p data-path-to-node=\"7,2,0\"><b data-path-to-node=\"7,2,0\" data-index-in-node=\"0\">2-4<\/b> These TOS, in addition to any terms, guidelines, or rules provided by the Se<span class=\"citation-18469 citation-18470 citation-end-18470\">rvice Provider and\/or approved by the user or subscriber (including but not limited to our service contract), are hereby incorporated by reference into the TOS.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"7,3,0\"><b data-path-to-node=\"7,3,0\" data-index-in-node=\"0\"><span class=\"citation-18467 citation-18468\">2-5<\/span><\/b><span class=\"citation-18467 citation-18468 citation-end-18468\"> Service Provider may also offer other services or new services that are governed by different Terms of Service, which will be set and added accordingly.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"7,4,0\"><b data-path-to-node=\"7,4,0\" data-index-in-node=\"0\"><span class=\"citation-18466\">2-6<\/span><\/b><span class=\"citation-18466 citation-end-18466\"> By accessing or using any part of the application or s<\/span>erv<span class=\"citation-18464 citation-18465 citation-end-18465\">ices, You agree that You have read, understand, and agree to be bound by this TOS.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"7,5,0\"><b data-path-to-node=\"7,5,0\" data-index-in-node=\"0\"><span class=\"citation-18462 citation-18463\">2-7<\/span><\/b><span class=\"citation-18462 citation-18463 citation-end-18463\"> If there are additional posted guidelines, policies, or rules applicable to the Services or application (including the privacy policy),<\/span><span class=\"citation-18462 citation-end-18462\"> You are required to follow those as well. Those policies and guidelines are incorporated herein <\/span>by re<span class=\"citation-18461 citation-end-18461\">ference into this TOS. If You do not agree to be bound by the TOS and to follow all applicable laws, guidelines, and policies, do not access or use the application\/services and leave it immediately. Any express or implied Use by You or under <\/span><span class=\"citation-18460\">your directions or assistance without agreeing to be bound by these TOS will represent and be deemed an express violation of the Service Provider&#8217;s rights and will entitle the Service Provider to prosecute You and seek full <\/span><span class=\"citation-18459 citation-18460 citation-end-18460\">remedy from You for such violations.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"7,6,0\"><b data-path-to-node=\"7,6,0\" data-index-in-node=\"0\"><span class=\"citation-18457 citation-18458\">2-8<\/span><\/b><span class=\"citation-18457 citation-18458 citation-end-18458\"> Internet Technology and applicabl<\/span><span class=\"citation-18457 citation-end-18457\">e laws, rules, and regulations change frequently. Accordingly, Service Provider reserves the right to make changes to this TOS at any time. Your continued use of the Website constitutes implied assent to any new or modified provisio<\/span>n of<span class=\"citation-18456 citation-end-18456\"> these TOS that may be posted on the application\/services. We will post the amended TOS on this page and indicate at the top of the page the date the Agreement was last revised.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"7,7,0\"><b data-path-to-node=\"7,7,0\" data-index-in-node=\"0\"><span class=\"citation-18455\">2-9<\/span><\/b><span class=\"citation-18455 citation-end-18455\"> Service Provider reserves the right to update, change, or amend these TOS at any time, with or without notice, and for any reason by posting the revised version on the application\/site. <\/span>Revisions to terms affecting existing Service Provider Services shall be effective immediately after posting at the Website\/Mobile Application. Terms for new Service Provider services are effective immediately upon posting on the Website. The continued access or use of this application and any Services contained therein as of the effective date of any such modification shall be deemed your continuing acceptance of thes<span class=\"citation-18453 citation-18454 citation-end-18454\">e TOS, as modified.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><h3 data-path-to-node=\"9\"><span class=\"citation-18451 citation-18452 citation-end-18452\">3. The Services<\/span><\/h3><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"10\"><li><p data-path-to-node=\"10,0,0\"><b data-path-to-node=\"10,0,0\" data-index-in-node=\"0\"><span class=\"citation-18449 citation-18450\">3-1<\/span><\/b><span class=\"citation-18449 citation-18450\"> The Term <\/span><b data-path-to-node=\"10,0,0\" data-index-in-node=\"13\"><span class=\"citation-18449 citation-18450\">Services<\/span><\/b><span class=\"citation-18449 citation-18450 citation-end-18450\"> in this TOS refers to and includes by reference all and any Website Services, Applications, and Products provided or agreed to be provided by the Service Provider to You which are subject to compliance with the notices, terms, and conditions set forth below <\/span><span class=\"citation-18449 citation-end-18449\">and elsewhere on this application\/services (including but not limited to our<\/span> Privacy Policy).<\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"10,1,0\"><b data-path-to-node=\"10,1,0\" data-index-in-node=\"0\">3-2<\/b> Except as expressly provided below, Services may only be used by individuals who can form legally binding contracts<span class=\"citation-18448 citation-end-18448\"> under applicable law. Without limitation, minors are prohibited from becoming Users except when and as specifically provided below, using fee-based Services. Your use of the Services will be deemed to be a representation that You are 18 years of age or older or otherwise are an entity that can form legally bind<\/span>ing contracts under applicable law. You must comply with all of the terms and conditions of these<span class=\"citation-18447\"> TOS, any policies referred to below or on the application\/services, and all applicable laws, regulations, and rules when You use the a<\/span><span class=\"citation-18446 citation-18447 citation-end-18447\">pplication\/services.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"10,2,0\"><b data-path-to-node=\"10,2,0\" data-index-in-node=\"0\"><span class=\"citation-18444 citation-18445\">3-3<\/span><\/b><span class=\"citation-18444 citation-18445 citation-end-18445\"> Subject to the terms and conditions of these TOS, you are hereby granted a limited, rev<\/span><span class=\"citation-18444 citation-end-18444\">ocable, conditional, and non-exclusive right to use the Services and the content and materials on the application\/services in th<\/span>e <span class=\"citation-18443 citation-end-18443\">normal course of your use of the application\/services. During or for the purpose of getting access to the Services, you may not use any third-party intellectual property without our consent and the express written p<\/span>ermission of t<span class=\"citation-18442 citation-end-18442\">he applicable third party, except as permitted by law. Service Provider will retain ownership of its intellectual property rights and You may not obtain any rights therein by virtue of these TOS or otherwise, except as expressly set forth in these TOS. You will have no right to us<\/span>e, copy, <span class=\"citation-18440 citation-18441\">display, perform, create derivative works from, distribute, have distributed, transmit or sublicense from materials or content available on the application\/services, other than as may be reasonably necessary to use the Services for t<\/span><span class=\"citation-18438 citation-18439 citation-18440 citation-18441 citation-end-18441\">heir intended purpose and except as expressly set forth in <\/span><span class=\"citation-18438 citation-18439 citation-18440 citation-end-18440\">these TOS. You may not attempt to reverse engin<\/span><span class=\"citation-18438 citation-18439 citation-end-18439\">eer any of the technology used to provide the Services.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"10,3,0\"><b data-path-to-node=\"10,3,0\" data-index-in-node=\"0\"><span class=\"citation-18436 citation-18437\">3-4<\/span><\/b><span class=\"citation-18436 citation-18437 citation-end-18437\"> If You become aware of any conduct that violates th<\/span><span class=\"citation-18436\">ese TOS, Servic<\/span><span class=\"citation-18435 citation-18436 citation-end-18436\">e Provider requests and encourages You to contact us. S<\/span><span class=\"citation-18435\">ervice Provider reserves the right, but will have no obligation, to respond to such communication<\/span><span class=\"citation-18433 citation-18434 citation-18435 citation-end-18435\">s. Service Provider provides Services accessible on different equipment and devices including but not limited<\/span><span class=\"citation-18433 citation-18434 citation-end-18434\"> to certain mobile devices and Computers, which You are providing for this purpose. Service Provider is <\/span><span class=\"citation-18433 citation-end-18433\">not liable to provide the required devices or the telecommunication facilities (i.e., internet connection or mobile service).<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"10,4,0\"><b data-path-to-node=\"10,4,0\" data-index-in-node=\"0\"><span class=\"citation-18432\">3-5<\/span><\/b><span class=\"citation-18432 citation-end-18432\"> Service Provider will use its best endeavors to keep the Servic<\/span>es always running and applicable to lawful Users complying with these TOS. But the Service Provider will be neither responsible nor liable for any failure or suspension of the Services Pr<span class=\"citation-18431 citation-end-18431\">ovided, pursuant and subject to the provisions of this Agreement\/TOS, for any reason and for any term.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><h3 data-path-to-node=\"12\"><span class=\"citation-18430 citation-end-18430\">4. User Registration and Passwords<\/span><\/h3><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"13\"><li><p data-path-to-node=\"13,0,0\"><b data-path-to-node=\"13,0,0\" data-index-in-node=\"0\"><span class=\"citation-18429\">4-1<\/span><\/b><span class=\"citation-18429 citation-end-18429\"> You do not have to register in order to visit the application\/services. But, to access certain features of the Services, you will need to register with the Service Provider and create a &#8220;User&#8221; account through the online registration process on the<\/span> Website. This account gives You access to the Services and functionality that we may establish and maintain from time to time and in our sole discretion. In creating an account, you must provide Ser<span class=\"citation-18428 citation-end-18428\">vice Provider with accurate and complete registration information, as prompted in the registration form. You must promptly notify Service Provider if any of this information changes.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"13,1,0\"><b data-path-to-node=\"13,1,0\" data-index-in-node=\"0\"><span class=\"citation-18427\">4-2<\/span><\/b><span class=\"citation-18427 citation-end-18427\"> If You fail to provide or update the information referred to in 4-1, the Service Pr<\/span>ovider may reject or terminate your right to use the app<span class=\"citation-18426 citation-end-18426\">lication or the Services. In case this is your first approach to Service Provider, and once your registration is completed, you will be directed to request the Service Provider to open an account for You and provide You Passwords to said account. You will be asked to choose a password and such chosen password will be recorded and treated as your p<\/span>assword and means of access to the account You opened. You must always keep your password confidential. You will be responsible for all use of your password and account, and You will be always liable and answerable to the Service Provider or to any aggrieved party for any consequences resu<span class=\"citation-18424 citation-18425 citation-end-18425\">lting from your failure to keep the password secure, including, without limitation, any use by any unauthorized third party.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"13,2,0\"><b data-path-to-node=\"13,2,0\" data-index-in-node=\"0\"><span class=\"citation-18422 citation-18423\">4-3<\/span><\/b><span class=\"citation-18422 citation-18423 citation-end-18423\"> You must notify Service Provider immediately if You believe your password or account has been obtained or may be accessed or used<\/span><span class=\"citation-18422 citation-end-18422\"> by any unauthorized person or entity. In addition, you must notify Service Provider immediately if You become aware of any other breach or attempted breach of the security of the application or the<\/span> Services. Under no circumstances should You respond to a request for your password, particularly a request from an individual claiming to be an employee of Service Provider. Service Provider employees will<span class=\"citation-18421 citation-end-18421\"> never ask for your password. You must notify Service Provider if You receive such a request. Three consecutive logon failures will result in suspension of your login information requiring You to contact the Service Provider via email to revalidate your Login information.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"13,3,0\"><b data-path-to-node=\"13,3,0\" data-index-in-node=\"0\"><span class=\"citation-18420\">4-4 Consent to<\/span><span class=\"citation-18418 citation-18419 citation-18420\"> Communications from Service Provider:<\/span><\/b><span class=\"citation-18418 citation-18419 citation-18420 citation-end-18420\"> By registering as a User and providing Se<\/span><span class=\"citation-18418 citation-18419\">rvice Provider your email address, you consent to our using the email address to send You Service-related notices, including any notices required by law, in lieu of communicatio<\/span><span class=\"citation-18416 citation-18417 citation-18418 citation-18419 citation-end-18419\">n by postal mail. You may opt-out of such S<\/span><span class=\"citation-18416 citation-18417 citation-18418 citation-end-18418\">ervice-related emails by choosing the <\/span><span class=\"citation-18416 citation-18417 citation-end-18417\">option stating You do not wish to receive such emails and would rather use an alternative form of communication, subject to approval by the Service <\/span><span class=\"citation-18416\">Provider. We may also use your email address to send You other messages, including changes to features of the Services and special<\/span><span class=\"citation-18415 citation-18416 citation-end-18416\"> offers. If You do not want to receive such email <\/span><span class=\"citation-18415\">messages, you may opt-out. Opting out may prevent You from receivin<\/span><span class=\"citation-18414 citation-18415 citation-end-18415\">g email messages regarding updates, improvements, or offers. But please note that if You request closing your email<\/span><span class=\"citation-18414\"> without providing an alternative form of communication, the Service Provider shall have the right to susp<\/span><span class=\"citation-18412 citation-18413 citation-18414 citation-end-18414\">end your account provisionally or for good and invalidate the use of your Password, without notification. And Yo<\/span><span class=\"citation-18412 citation-18413\">u accept that under such circumstances You shall have no right of an<\/span><span class=\"citation-18411 citation-18412 citation-18413 citation-end-18413\">y legal recourse against Service Provider.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><h3 data-path-to-node=\"15\"><span class=\"citation-18408 citation-18409 citation-18410 citation-end-18410\">5. Account Security<\/span><\/h3><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"16\"><span class=\"citation-18405 citation-18406 citation-18407 citation-end-18407\">You are responsible for safeguardi<\/span><span class=\"citation-18405 citation-18406 citation-end-18406\">ng the<\/span><span class=\"citation-18405 citation-end-18405\"> password that You use to access the Services and You agree not to disclose your password to any third party. You a<\/span><span class=\"citation-18404 citation-end-18404\">re responsible for any activity using your account, whether or not You authorized that activity, and whether or not You have prior knowledge of the unlawful access to your account. You should immediately notify Service Provider of any unauthorized use of your ac<\/span>count.<\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"17\">You acknowledge that if You wish to protect your transmission of data or files to Service Provider, it is your responsibility to use a secure encrypted connection to comm<span class=\"citation-18403 citation-end-18403\">unicate with the Services.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"18\"><span class=\"citation-18402\">Subject to your compliance with these TOS, You are granted a conditional, limited, non-exclusive, non-licensable, non-assignable, paid license to personally download and install, use\/apply the Software on your personal co<\/span><span class=\"citation-18401 citation-18402 citation-end-18402\">mputer, mobile phone or other device and personally use the Service\/products\/application through your account <\/span><span class=\"citation-18401 citation-end-18401\">(as applicable) (&#8220;User Account&#8221;) for the time or duration agreed by the Parties to this TOS.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><h3 data-path-to-node=\"20\"><span class=\"citation-18400 citation-end-18400\">6. Licensing Limitations<\/span><\/h3><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"21\"><li><p data-path-to-node=\"21,0,0\"><b data-path-to-node=\"21,0,0\" data-index-in-node=\"0\"><span class=\"citation-18399\">6-1<\/span><\/b><span class=\"citation-18399 citation-end-18399\"> For the avoidance of doubt:<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"21,0,1\"><li><p data-path-to-node=\"21,0,1,0,0\"><span class=\"citation-18398 citation-end-18398\">(a) IT administrators working on behalf of an e<\/span>ntity (representing the User or which the User is the owner of) may, subject to prior agreement between the Service Provider and User, download and install the Service Provider Software onto personal computers or other devices used by personnel of such entity; and<\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"21,0,1,1,0\">(b) You are permitted to use the Service Provider application or Services.<\/p><\/li><\/ul><\/li><li><p data-path-to-node=\"21,1,0\"><b data-path-to-node=\"21,1,0\" data-index-in-node=\"0\">6-2<\/b> All rights and l<span class=\"citation-18396 citation-18397 citation-end-18397\">icenses granted to You (as User) under these TOS are granted temporarily, and the Service Provider reserves to itself all other rights not expressly granted to You under these TOS\/Agreement.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><h3 data-path-to-node=\"23\"><span class=\"citation-18394 citation-18395 citation-end-18395\">7.
